I-Canada-News.Com, May 10, 2013 ) ONTARIO, CANADA – Windsor personal injury law firm Greg Monforton & Partners received a winning appeal judgment Wednesday from the Ontario Court of Appeal in their case Jubenville v. Jubenville. The case was an appeal of a decision made in October 2012 regarding the plaintiff Ashley’s eligibility to collect under the uninsured motorist coverage of an Economical Mutual Insurance Company policy.

Economical Mutual Insurance Company filed an appeal after the Ontario Superior Court of Justice determined that Ashley Jubenville was entitled to benefits from the uninsured motorist coverage of her mother Kelly’s car insurance policy for an accident that occurred in 1993, when Ashley was only 5 years old.
At the time, Ashley was traveling in a vehicle with her father Kevin, who was the registered owner of the car; however the car was not covered by any insurance policy. The case was largely concerned with the question of whether Kevin’s automobile would be considered an “uninsured automobile” for the purposes of Ashley receiving coverage under Kelly’s policy, considering that Kevin and Kelly were married at the time of the accident.
Ms. Pearce said: "We are relieved to see that our Court of Appeal saw the unfairness that would have resulted to our client, an innocent accident victim, if she were not permitted to recover under the Economical policy. The law was quite clear that our client was entitled to the benefit of the policy’s coverage and we fought hard to ensure she got what she deserved. Our client is very pleased with the Court's decision.”
This victory comes on the heels of several high-profile cases being managed by the firm, including a fatal, multi-car accident involving a large truck on I-75 in Michigan.
